Terms of Use
Popcorn Club is one movie revealed every evening for the whole community, with shared ratings, reviews, and a discussion feed. These terms set the ground rules so the Club stays a pleasant place. By using the app or this site, you accept them.
1. Publisher and contact
Popcorn Club (the iOS app and the getpopcorn.club site) is published by Maxime Damery, an independent developer. For any question, complaint, or report, write to maxsimd0@gmail.com.
The site is hosted by Vercel Inc. (440 N Barranca Ave #4133, Covina, CA 91723, United States). The app's data is hosted by Google (Firebase).
2. Purpose
These terms of use govern access to and use of Popcorn Club. They apply to anyone who uses the app or the site. If you don't accept them, please don't use the service.
Popcorn Club lets you, among other things:
- discover the movie of the night, revealed at the same time for your whole region;
- rate movies, post reviews, and react in the feed of the day's movie;
- vote in the Club to steer which movies come next;
- keep your history, favorites, and lists, and import your Letterboxd history;
- earn popcorns and customize your avatar;
- see which platforms a movie is available on and watch its trailer.
The service is free. It contains no ads and no in-app purchases. Votes steer the lineup, but we may set a title aside, for example if it isn't available or isn't suitable for the community.
3. Access and account
The app works with an anonymous account: a technical identifier is created the first time you open it, with no email or password. This account is tied to your installation: if you delete the app or change devices, it may not be recoverable.
To post in the feed, you choose a username. It is public and must follow the rules in section 4: no insults, hate speech, impersonation (of another member or a public figure), or advertising. You are responsible for how your account is used.
You may not circumvent the service's safeguards: creating multiple accounts to sway votes or earn popcorns, automation, bulk data scraping, or attempting to access other members' accounts or our servers.
4. Content posted by members
You can post ratings, reviews, and reactions in the feed of the day's movie, as well as a username and an avatar visible to other members ("Content"). You are solely responsible for the Content you post.
Zero tolerance. Popcorn Club has zero tolerance for objectionable content and abusive users. You may not post Content that:
- insults, harasses, threatens, or intimidates any person or group;
- is hateful or discriminatory (origin, religion, gender, sexual orientation, disability, etc.);
- is sexual or pornographic, or sexualizes minors;
- incites violence, self-harm, or suicide;
- is illegal or defamatory, or infringes others' rights (copyright, privacy, impersonation);
- is advertising, fraudulent, or repetitive (spam);
- reveals a movie's plot without being marked as a spoiler (the "This review contains a spoiler" option in the review editor).
Don't post personal information, yours or anyone else's (address, phone number, and so on). Respect other people's opinions: you can dislike a movie without attacking those who love it.
Filtering. Text is checked automatically before it is posted: text containing insulting or hateful terms is rejected.
5. Reporting and blocking
Report. You can report any review, message, or profile from the "…" menu by choosing a reason and, if needed, adding details. The reported member never learns who reported them. You can also write to maxsimd0@gmail.com.
Block. From the same menu, you can block a member: their reviews and messages are no longer shown to you. Your list of blocked members and unblocking are in Settings › Blocked users.
6. Moderation and enforcement
We review reports within 24 hours and remove any Content that breaches these terms. Content reported by several members may be hidden automatically until we decide; it reappears if the report turns out to be unfounded.
If you break these rules, we may, without notice and depending on severity:
- remove or hide the Content concerned;
- reset a username;
- ban the account, which disables its access to the service and prevents it from coming back;
- report illegal content to the relevant authorities.
If you believe a moderation decision is unjustified, write to maxsimd0@gmail.com with your username and we will review it again.
7. Intellectual property
The app, the site, their design, text, illustrations (including avatars), and code belong to the publisher and are protected by intellectual property law. You may not copy, modify, or distribute them without permission.
You keep ownership of your Content. By posting it, you grant Popcorn Club a non-exclusive, royalty-free, worldwide license to host, reproduce, and display it in the app and on getpopcorn.club (for example as excerpts of reactions on movie pages) for as long as it is published. This license ends when you delete the Content or your account, subject to the technical time needed to remove it.
8. Popcorns and virtual rewards
Popcorns are an in-game virtual currency. You earn them by taking part (daily missions, streak, chest) and use them to vote in the Club or unlock avatar items.
- They have no monetary value: they cannot be bought, sold, traded between members, or converted into money or goods.
- There is no paid chance-based mechanic: the chest and missions give fixed rewards, and popcorns never depend on the outcome of a vote.
- We may change how popcorns are earned and used, correct an incorrect balance, and remove popcorns obtained through fraud (multiple accounts, automation, exploiting a bug).
- Popcorns and unlocked items are tied to your account and disappear with it.
9. Third-party content and services
Popcorn Club relies on third-party services, which remain subject to their own terms:
- The Movie Database (TMDB) provides movie entries, posters, and images. This product uses the TMDB API but is not endorsed or certified by TMDB.
- JustWatch provides streaming availability data. This information is indicative and may change without notice.
- YouTube hosts the trailers, which play in YouTube's embedded player and are subject to YouTube's terms of service.
- Letterboxd: your history is imported only if you start the import yourself. Popcorn Club is not affiliated with or endorsed by Letterboxd.
Movie posters, titles, and trademarks, and those of streaming platforms, belong to their respective owners. Popcorn Club does not stream the movies themselves.
10. Availability and liability
We do our best to keep the service running without interruption, but it is provided "as is": outages, errors, or maintenance may occur. Reveal times, the lineup, and movie data may change. We may modify, suspend, or discontinue all or part of the service.
To the extent permitted by law, the publisher is not liable for indirect damages arising from use of the service (data loss, interruption), for Content posted by members, or for information provided by third-party services. Nothing in these terms limits the rights you have by law as a consumer.
11. Termination and account deletion
You can stop using Popcorn Club at any time. To erase your data, use Settings › Delete my account: your profile, username, history, ratings, reviews and messages, popcorns, reports, and blocks are permanently deleted. You can also request it at maxsimd0@gmail.com.
We may suspend or delete an account that breaches these terms, as described in section 6.
12. Minors
Popcorn Club is rated 13+ on the App Store because of the content posted by members. The service is, however, not intended for children under 15, in line with our privacy policy. If you notice that an account was created by a child under 15, contact us so we can delete it.
13. Personal data
The data processed to run the service, including reports and blocks, is described in the privacy policy.
14. Changes
These terms may evolve with the service. If there is a significant change, we will let you know in the app. The date of the last update appears at the top of this page. Continuing to use Popcorn Club after a change means you accept the new terms.
15. Governing law and disputes
These terms are governed by French law. If you disagree with something, please write to us first at maxsimd0@gmail.com so we can find an amicable solution. Failing that, the dispute will be brought before the competent French courts, without prejudice to the consumer protection rules of your country of residence.
